If you don’t understand why people don’t like the big bang theory, once in an episode the cast was at a comic store browsing and a woman walked in, and one of the leads said “Is she lost?” and that was the joke.
The woman in question carries a rare genetic disease that could be transmitted onto her baby, but the couple still wants to have children and has every reason to wish so. Which brings us to the question: why did she end up having an abortion in a hospital bathroom? I wanted to take this chance to share this sad piece of news but also give you a bit of information on how abortion and ART work in Italy.
Let’s start off with ART. Which means that a couple cannot have children for various reasons, mainly infertility, and they seek medical and technological aid to be able to procreate. In Italy it’s pretty much illegal. As is research on the subject. It’s been debated for years and we even held a referendum in 2005 to abrogate the law, but the quorum wasn’t reached (not enough people voted) and the legge 40 (the law that regulates everything I’ve talked about in this paragraph) is still in use today. The consequence is that if you’re Italian and want to try ART to have a baby, you need to cross the border and search for a foreign clinic. If you can afford it, of course. One of the reasons the referendum failed was the heavy propaganda of Catholic figures, political parties and associations, who either asked people to vote against or to not vote at all.
Then there’s artificial insemination. This is the case where both partners are able to procreate but they can’t do it by having sex. Again, this can happen for many reasons: there’s not enough semen to have successful insemination during intercourse, there are genetic diseases involved, like Valentina, the woman of the article above, who needed to perform PGD before starting a pregnancy to ensure that the baby doesn’t inherit the disease and so on. This is regulated by the same law as ART, and it was part of the same referendum in 2005. The easy solution, if you have the money, is once again going abroad (or, you know, not having a baby at all). The hard solution is appealing to a court of law and investing money and time (years) for something you don’t have many chances of winning.
Valentina has a rare disease but since she can procreate, the legge 40 says she can’t undergo artificial insemination or PGD. So, when she found out she was pregnant, she had to wait until it was possible to check if the fetus would carry the same disease. Eventually it was confirmed that that was the case, so Valentina and her husband decided for abortion. You can read her story here (IT).
Abortion in Italy is subject to the legge 194 (we’ve had this law since 1978), which says that you can willingly decide to undergo induced abortion in:
- The first 90 days, in general
- The first four/five months, only for therapeuthic reasons or if the pregnancy and/or the delivery may seriously compromise the woman’s health.
There are other specifics, such as authorization by tutors and cases of mental illnesses but this is it, there’s nothing further than the fifth month unless you’re about to die.
Now, this doesn’t look too catastrophic, I mean, some countries have it way worse than us. So how did Valentina end up in that bathroom? Because of Conscientious objectors. The Law 194 says that a gynecologist can object, but that the rest of the personnel cannot, especially if the woman is in danger. The gynecologist cannot refuse to intervene, even if they are objectors, in case of emergencies. Being an objector is only related to abortion. An objector cannot refuse to sell condoms or the pill (RU486) or to write a prescription for the pill, which is mandatory to buy it, in Italy. Those are not methods that induce abortion, so refusing to provide them to the patient is illegal.
The reality is that objectors refuse to do those things as well and they’re spreading like plague all over Italy, to the point where some regions have such a high rate of objectors that it’s impossible to have abortion (and again, if you can, you go elsewhere; if you can’t, there’s illegal abortion with all the dangers it entails). A lot of women report of not being able to buy the pill or of being treated like killers while they were buying it. If this is the treatment for the pill, you can easily imagine what it’s like for abortion. When you’re lucky enough to find a doctor who is not an objector, as it happened to Valentina, you go to the hospital.
The problem arose because this woman was getting an induced abortion, but during the process there was a change of shifts and the doctors who came in were objectors, so they refused to help her. She ended up in that bathroom without assistance, with her husband asking for help in vain and with anti-abortion activists showing up, Gospel in hand. This kind of sick activism is unfortunately very widespread in hospitals, it’s not rare to see these people (Catholic extremists) with Bibles and photos of fetuses ready to address you as “murderer” because apparently a 1 week old fetus is more of a living creature than you.
We can’t deny it’s the consequence of religion being way too much involved in the matters of the State. Many of our public hospitals are Catholic, after all, it’s not surprising that there are so many objectors. It’s surprising that such a concept is allowed by law in the first place. Apparently Europe noticed and recently declared that the legge 194 violates social rights, which, if I understood correctly, means that Italy has to take measures to change the law, hopefully for the better.

La denuncia è arrivata da Valentina e Fabrizio, i due giovani romani protagonisti della vicenda presentata dall’Associazione Coscioni durante una conferenza stampa.
La coppia romana ha scoperto nel 2010 che la bimba che attendeva era affetta da una grave malattia genetica, di cui la madre era portatrice, per cui non c’è una prognosi di sopravvivenza, e ha deciso quindi di interrompere la gravidanza al quinto mese.
«OBIETTORI CON IL VANGELO».«Riesco, dopo vari tentativi, ad avere da una ginecologa dell’ospedale Sandro Pertini un foglio di ricovero, perchè soltanto lei non era obiettore», ha raccontato la donna. «Entro in ospedale e inizio la terapia per indurre il parto. Dopo 15 ore di dolori lancinanti, vomito e svenimenti partorisco dentro il bagno dell’ospedale con il solo aiuto di mio marito. Nessuno ci ha assistito, nemmeno dopo aver chiesto aiuto più volte. Anzi a un certo punto sono entrati gli obiettori con il Vangelo in mano a dirci che commettevamo un crimine. Non li abbiamo denunciati soltanto perché eravamo sconvolti da quello che avevamo vissuto».
GALLO: «INUTILE CHE IL MINISTRO NEGHI». Il problema degli obiettori è stato sollevato recentemente anche dal Consiglio d’Europa, che ha condannato l’Italia.
«È inutile che il ministero neghi il problema, che invece esiste», ha affermato Filomena Gallo, segretario dell’associazione, che ha assistito la coppia, «la legge 194 prevede che le strutture debbano garantire il servizio di interruzione di gravidanza, e non lo fanno. Le responsabili sono le Regioni, che abbiamo più volte sollecitato e che però non si attivano».
In questo caso, ha spiegato Gallo, la procedura, che è un aborto a tutti gli effetti, era stata iniziata dal medico non obiettore, ma poi al cambio del turno erano arrivati medici obiettori: «Ma la legge prevede», ha sottolineato, «che il medico possa rifiutarsi di iniziare la procedura, ma non di portarla a termine».
